Nadia Primc: Organ Transplant for the Mentally Handicapped. Dangers of a Covert Discrimination
Mentally retarded patients run the risk of being covertly discriminated when they seek access to cadaveric donor organs, so that in opposition to other patients suffering from a severe organ failure they are not offered the best medical treatment. The medical judgement leads to a systematic disadvantage if they are denied access to the waiting list just because of their mental retardation, without individually taking into account the support from their social environment and their former handling of therapeutic demands.

Les patients ayant un handicap mental risquent d’être discriminés lorsqu’ils cherchent à accéder à des greffons issus d’un don post mortem, de sorte qu’ils n’obtiennent pas le meilleur traitement médical, contrairement à d’autres patients. Le jugement médical entraîne un préjudice systématique, si l’accès à la liste d’attente leur est refusé seulement à cause de leur handicap mental, sans tenir compte, dans chaque cas individuel, du soutien de leur environnement social et de leur comportement antérieur face à des exigences thérapeutiques.
